AirAdvisor is an ambitious and fast-growing startup with a clear vision for international expansion, aiming to reach 1 million claims by the end of 2026.RoleWe are seeking a highly skilled and dedicated Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections. You may own or want to open your own boutique law firm in Italy. Pre-court collections are managed by a team of paralegals. You will be responsible for filing batches of court cases to recover compensation and/or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and/or recover ticket refunds. AirAdvisor currently handles three types of airline claims: EU261 compensation for flight delays, cancellations, and denied boarding, and three types of baggage claims under the Montreal Convention: lost, delayed, and/or destroyed luggage.If the law or a judge decides the case unfairly, we may escalate this to change the law where feasible. There may be PR opportunities regarding court victories and essential legal issues to raise public awareness. This is an excellent opportunity for high performers who can self-perform, have strong litigation experience, and advocate for consumer rights in the airline industry.The candidate must be free from conflicts of interest and able to litigate against different airlines.RequirementsA valid Attorney at Law license in Italy and professional liability insurance.A law degree from an accredited institution.Experience with small claims, consumer rights, or aviation law is a plus but not required.Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required.Proven track record of success in in-court collection.Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies.Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.Experience in automating and standardizing claims management processes to scale up quickly.ResponsibilitiesAct as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction.If feasible, assist in establishing a law firm in Italy, including corporate structuring and registering as foreign legal counsel, among other formalities.Pre-court collections and out-of-court settlements.Prepare and file batches of approx. 200+ new claims monthly in Italian courts against various airlines for: (a) Compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation; (b) Reimbursement of out-of-pocket expenses incurred by passengers under EU261/2004 or the Montreal Convention; (c) Ticket refunds owed to passengers; (d) Handle baggage-related claims under the Montreal/Warsaw conventions; (e) Respond to airline defenses and enforce court judgments.Lead enforcement proceedings and coordinate with bailiffs or enforcement authorities if necessary.Engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable in-court settlements.Maintain complete and accurate legal case files in compliance with Italian legal ethics and data protection regulations.Conduct thorough legal research and comparative analysis to build best practices for managing recurring issues in airline and consumer rights litigation.Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated legal advice and representation.Pursue legal remedies, including appeals, where appropriate, and advocate for legislative changes if feasible.Support optimization and automation of claims management workflows using technology, including AI-based tools, to improve efficiency and scale.Identify and propose new civil claims opportunities under Italian law for low-value, high-volume litigation, including but not limited to bank and financial disputes and labour law-related claims.Conduct cross-jurisdictional legal research across EU/UK markets to adapt precedents for Italy in complex scenarios.Represent AirAdvisor in local media and coordinate with PR to leverage public awareness of consumer rights.Review and vet content as needed to help build local trust and authority; advocate for passenger and consumer rights in aviation.Soft skillsProfessional, ambitious, open to testing AI optimization solutions and new approaches to claims management.
